My neighbour is extending his house and wants to?

buy a narrow strip of land off me. It's only a couple of metres wide and perhaps 20 metres long (exact figure not calculated as yet). I'd prefer not to sell, but I will as they are decent people and never give me any bother. I have absolutely no idea what to charge him. Is there any way which this is normally calculated (eg % of value of my land etc?). This will also involve removing a strip of hedge. Can I insist that he re-instates this hedge to my specification? He wants to put a beech hedge in but it's a hawthorn hedge and I'd rather he keeps it that way.

Lots of advise on appraising the land, legal consult etc, all of which is very important. But you commented you preferred not to sell, but you would since they are decent people with no bother. I doubt that even if you both agreed to maintain a hedge, in the end, as owners of the property, you probably wouldn't have the upper hand. Also, one other important thing, what if they decide to sell their place, which now includes your "former" strip. You have no guarantee that the next neighbors will be kind, or even decent. They will have no obligation to you.
Reply:First off why does he need your land? Can't he extend his house on his land instead? Selling even a tiny part of your land will make the value go down on your land. I would have the land appraised that way you will know what to charge him.
Reply:You need proffesional advice and documents drawn up by a solicitor. It cant be calculated by speculation. An estate agent will tell you what its worth.
Reply:To calculate the cost of land, find out what the going price is in your area, or the land value of your own home in square metres then by the measurement you are selling him by square metres.


You should have the right to what suits you as far as hedge goes as you are kind enough to sell to him. You also have to look at costs involved legally and what would it cost to buy the hedge plants he wants to remove??? If very established they could be very expensive in themselves.


Really these are the questions you should be asking them at this point, don't wait till you sell and have no control at all.


Maybe it may be better to not sell, and have him a little annoyed than have bigger problems caused through the new situation.
Reply:Please, please see a Solicitor experienced in property matters! He will explain the implications to you and will also write a POLITE letter to your neighbours. It's not expensive. Legally, you have the right to light. Extra buildings may take away your light, and the law also gives you the right to continue to enjoy your property in the same way as at present (think of the nuisance a B %26amp; B will cause) extra traffic for one! Where are the residents going to park and will you be disturbed at night? Once you've sold the land you will have no rights over it. If you give permission you will regret it for the rest of your life! What is your neighbour going to ask for next? He only has HIS interests in mind.
Reply:You need to consult with a lawyer who deals with land issues.
Reply:I heard of someone paying half a million for a tiny strip of land to add to their yard. Ask for what it's worth to you.
Reply:Call the county appraisers office or go there and look up your lot/plot #. Also ask them, they will be able to tell you how much your property is valued at and from there, you can figure out cost. Shoot high too especially if you really don't want to sell it. They might be deterred into NOT buying it after all if you ask too much. How bad do they want it ? Good luck.
Reply:You hold all the cards. Of coures you can insist he reinstates the hedge. And make sure it's hawthorn.





There's a bit of emotional blackmail going on here, and you might not realise it. Because if you don't agree to sell, he'll go in the huff with you and your quality of life will not be so good.





What you need to do is get an INDEPENDENT valuation of what the land's worth. I take it he'll pay all the legal fees etc. You need a solicitor now!!





Don't forget once he hasd the land, he might try to change the plans for the extension and build some monstrosity. And whatever he does build, will affect the value of your home. You are taking a double hit because he is effectively reducing the value of your home.





Remember there are no such thing as friends in a deal like this. It's all about MONEY. Personally I'd not enter into a deal like this, not a chance. He has put you in a difficult position by asking, but I advise you to say NO Don't give in to emotional blackmail; I sense you are a vulnerable person, otherwise why would you be asking us lot?
Reply:This could lead to trouble, do you have extra land and width of your lot, Subdivisions have minimum requirements, and if you have a Mortage holder, you cannot do this without there permission and the money will have to be applied to your mortage, - Don't do it, tell him your Lender will not allow it.
Reply:My god - you're under no pressure to sell what so ever, so don't if you don't want to! However you need to get a local estate agent or contact a local solicitor who should both be able to value the land for you. You need to consider how much it will devalue your property (which will depend on how much land you already have) and how much value it adds on to his (what's it worth to him?) You also need to consider usage - what does he want it for? If he wants to build a great big garage next to your house, you might need to say no.





You will need a solicitor anyway to arrange for the official transfer of land and this will need to be paid for - obviously he should meet these costs, but I really would advise you to see a solicitor ASAP. As you have no obligation to sell, it's up to you to agree the terms and conditions of the sale, therefore if you want a Hawthorn hedge, make that a condition of the sale!

Reply:its best to get advice from a soliciter about your hedge tell him if he wants the land he as got to put it back the way it was he needs the land so he will do as you say
